In some respects, Barnsley Hospitals NHS Foundation Trust v MSP1 (MSP) is a paradigm of compliance with the United Nations Convention on Rights Persons Disabilities 2006 (CRPD). Faced challenging decision over whether to withdraw life-sustaining treatment from 34-year-old complex abdominal problems, Mr Justice Hayden delivered sensitive but forceful judgment, which placed substantial weight individual’s previously expressed wishes, even in face clear conflict his clinical interests. doing so, he emphasised importance looking at patient’s perspective, asking not continued life was objectively worthwhile, patient would regard it so.
